As a participant in the CreditBack Rewards Program ("Program"), you can earn CreditPoints when you shop for goods or services at CreditBack Affiliated merchants.

Your participation in the Program and receipt of its benefits are made available at the discretion of CreditBack. CreditBack reserves the right to modify the Program from time to time, with or without notice, and by your continued participation in the Program after any such modification, you shall be deemed to accept any such modification. If you do not agree to any modification that may be made to these or the Program Terms and Conditions, you must immediately cease participation in the Program and notify CreditBack in writing to terminate your account. It is your responsibility to check the creditback.com web site regularly to determine whether this Agreement or the Program Terms and Conditions have been modified.

The Program is a system for CreditBack participating merchants to reward you, the Member, with credits for frequent shopping, and also to make available special offers to you through CreditBack participating merchants. You may check your Account status and recent shopping history at any time by logging on to the creditback.com Web site using your e-mail address or card number, to access your Account.

All balances as reflected in CreditBack's records shall be deemed correct unless and until proven otherwise to the satisfaction of CreditBack or by decree of a court competent jurisdiction in the State of Utah. CreditBack reserves the right to determine the number of CreditPoints earned on any transaction. You shall comply with all applicable laws and regulations, including tax laws, relating to your access to and use of your Account. CreditBack may terminate your Account or the services offered immediately and without notice if:

(a) you breach this Agreement or the Program Terms and Conditions,

(b) you infringe upon the intellectual property rights of CreditBack or a third party in connection with your activities under this Agreement,

(c) CreditBack is unable to verify or authenticate any information you provide to CreditBack, or

(d) CreditBack discontinues the Program.

Membership in the Program is subject to this Agreement and the Program Terms and Conditions. Any failure to comply with the Program Terms and Conditions, any fraud or abuse relating to the accrual or redemption of CreditPoints or Rewards, or any misrepresentation of any information furnished to CreditBack or its Merchant Affiliates by you, or anyone acting on your behalf, may result in the termination of your membership in the Program, cancellation of your Account and/or forfeiture of your CreditPoints. In the event of your fraud, breach, or suspected fraud or breach by you or anyone acting on your behalf or under your password, CreditBack reserves the right to suspend access to your Account indefinitely pending investigation by CreditBack.
